1. Who may use Draft Hause

• You must be able to form a binding contract and meet the minimum age required in your jurisdiction (and not be a child under 13).
• Access is typically provided through an invitation or account created for a design studio / firm and its clients.
• If you use the Services on behalf of a company, you represent that you have authority to bind that company.

2. The Services

Draft Hause provides tools for interior design workflows, which may include:

• Project setup and management via the web portal
• Designer LiDAR / RoomPlan room capture on supported Apple devices
• On-device and/or server-assisted floor-plan generation and storage
• Uploading scan files, floor plans, and related project materials
• Role-based access for admins, designers, and clients
• Comments, milestones, notifications, and related collaboration features

Features may vary by role, subscription/arrangement with your studio, device capability (LiDAR), and product updates.

3. Accounts & security

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for activity under your account.
• Notify us promptly at info@drafthause.com if you suspect unauthorized access.
• We may suspend or terminate accounts that violate these Terms, pose a security risk, or are inactive according to our operational practices.

4. Acceptable use

You agree not to:

• Use the Services for unlawful purposes
• Upload malware, or attempt to disrupt or reverse engineer the Services except as allowed by law
• Access another user’s data without authorization
• Misrepresent your identity or affiliation
• Use scanning or location features to stalk, harass, or unlawfully surveil individuals
• Resell or sublicense the Services except under a written agreement with us
• Scrape or overload our systems in a way that harms service availability

5. Customer content (scans, plans, project files)

• You (or your studio) retain ownership of project content you submit (“Customer Content”), including scans and floor plans, subject to rights granted below.
• You grant Draft Hause a limited license to host, process, transmit, display, and back up Customer Content solely to provide and improve the Services for your studio.
• You represent that you have the rights needed to upload Customer Content (including permission to scan premises and share related materials).
• Floor plans and measurements are tools for design workflows; they are not certified survey documents unless expressly stated in a separate professional engagement.

6. Device requirements & Apple frameworks

• Room scanning requires a compatible Apple device with LiDAR / RoomPlan support.
• Scanning uses Apple system frameworks. Apple’s software license and privacy terms apply to those frameworks.
• We are not responsible for device limitations, OS changes, or Apple framework behavior outside our control.

7. Location features

If you grant location permission, we may store approximate capture coordinates with a scan. Location is optional. Denying permission does not prevent scanning. You must not use location features unlawfully.

8. Fees & studio arrangements

Commercial terms (including studio licensing, maintenance, or subscription fees) may be set out in a separate agreement, invoice, or order form with The Styled Hause, Inc. or your studio. The App Store listing may be free while access remains account-based.

9. Intellectual property

The Draft Hause name, branding, software, and documentation are owned by The Styled Hause, Inc. or its licensors. These Terms do not transfer ownership of our intellectual property to you. Feedback you provide may be used to improve the Services without obligation to you.

10. Third-party services

The Services may link to or integrate with third-party sites or tools (for example email infrastructure or external design links your studio stores). We are not responsible for third-party services we do not control.

11. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT FLOOR PLANS, MEASUREMENTS, OBJECT DETECTION, OR SCAN OUTPUTS WILL BE ERROR-FREE, SURVEY-GRADE, OR SUITABLE FOR ENGINEERING, LEGAL BOUNDARY, OR PERMITTING PURPOSES WITHOUT INDEPENDENT PROFESSIONAL VERIFICATION.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAFT HAUSE AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

13. Indemnity

You will defend and indemnify Draft Hause against claims arising from your Customer Content, your misuse of the Services, or your violation of these Terms or applicable law, to the extent permitted by law.

14. Suspension & termination

You may stop using the Services at any time. You may request account deletion as described in Data Deletion. We may suspend or terminate access for violations, non-payment under a commercial agreement, security risk, or discontinuation of the Services. Provisions that should survive (including IP, disclaimers, limitations, and indemnity) will survive termination.

15. Privacy

Our Privacy Policy explains how we collect and use personal data. By using the Services, you acknowledge that policy.

16. Changes

We may update these Terms. The “Last updated” date will change when we do. Continued use after changes become effective constitutes acceptance, except where local law requires additional consent.

17. Governing law

These Terms are governed by the laws of the United States and the state in which The Styled Hause, Inc. is organized, excluding conflict-of-law rules, except where mandatory consumer protections in your jurisdiction provide otherwise.
